Harassed by supervisor

Respected Members,

I was employed with one of the eminent organization in Gurgaon till 11-Aug-18 (Resident in Delhi). I want to file a complaint against my Supervisor. Since I joined his project (Nov-2017), his attitude towards me was really harsh. He always humiliated me by making insensitive and personal comments like “I don’t deserve to work here”, and “whoever promoted me in my last project, he will go and touch his feet because I don’t deserve to be promoted”. He often shouted me in an aggressive manner in front of others, and one day told me not to touch or do any work. He deteriorated my image by harassing and scolding me without any reason. Not only this, he revoked all my work access so that I can’t do any work and stopped allocating me any work and told me that if I won’t agree on his terms than I will suffer like this only.

He threatened me to give a written mail that I am not interested to do work so that he proved management that I am unfit for the role. I complained to my HR about all this, Supervisor has accepted that he made those insensate comments but no action was taken by HR. Now he started mentally pressurizing me to put resignation otherwise I will get a termination from the company. I was literally helpless when HR was not even giving edge to my grievance. In spite they planned to make a performance case for me so that I leave the organization by other means.

I have to put resignation for the sake of my self esteem and finally left the company. The harassment from which I have gone through cannot be described in words.

Please guide me where should I file a complaint.

Hello,

You can file a complaint against such employer if :

1. You are wrongfully terminated.

2. You have not received your due salary.

3.You have been subjected to harassment at office.

4. The terms of your Employment Agreement have been violated by employer  

 

Firstly, I would suggest you to send a legal notice to the employer and inform him about this and ask him to respond. A professional can include all the relevant details of the issue you have faced and draft a notice while discuss the remedy available in the matter with you accordingly can proceed in your matter.

Secondly, If the employer does not respond or send a reply to the legal notice sent by you, you can go ahead to file a complaint with the Labour Court in your jurisdiction.

You can file a complaint with the Labour court which has jurisdiction over the area where you reside or where you were employed.  

The contentions can be listed out in your petition too along with charges and compensation.
