Guardianship

Need a clarification to this particular case, A hindu minor child lost her parents. The child now has her maternal and paternal grandparents.

a) As per hindu act, who has the legal ownership to take over a her  legal guardian.

b) Child wants to be with maternal grands.

I'm not a lawyer but as far as I know, courts in such cases determine the custody based on child's welfare, not the rights of people. In this case, since child wants to be with maternal grandparents, if other aspects such as schooling and welfare are also fine in their custody, then they would get his guardianship.
