Gender Nuetral Taxation laws- Why men are discriminated

Indian taxation system is gender biased. Even today it gives preferential tax treatment to women, merely on the based on gender. Where men must start paying tax after 1.65 lakhs, women income is exempted till 1.95 lakhs. Today, Minister of women & child welfare has come saying that there should be different tax rate for men and women! Reasons she has given that women income goes for family happiness and children nutrition. What about men's income. Is it not spent on family? Is it not spent on children nutrition? Such statement by the Minister is not only factually incorrect, it is designed to humiliate men, it is sectarian gender politics, it is appeasement of feminists- I condemn it.

There must a "Ministry of Men & Child Welfare" and National Commission for Men to air men's views in governance.

Nice Suggestion. My opinion is Let us appoint one more minister for minstry of men and child welfare. Men are responsible to bring a child to this universe, therefore, men too have a responsibility and a major role in upbringing nunna and munnas. Those have mercy in their heart will introduce "Ministry for men and child welfare department.

thanks

We have seen various laws being justified in the name of "poor, uneducated, rural women' exploited by men.

What is justification of differential tax treatment to women, who are educated & earning. This is a discrimination for the sake of discrimination, this is a discrimination to insult & humiliate men, this is a discrimination to appease feminism- this is a discrimination rob men in form of unjustified taxation.

Child's welfare is not a monopoly of feminism. A man must have equal right in deciding as how a child welfare is ensured. Child welfare must not be in the hand of "Ministry of Women".

And what about men having tax exemption showing their income as the income of their female family members ?  :)

Rajesh Kumar (Advocate)     20 February 2010

@Suchitra- whenever state will make such laws, it will be misused, hence such laws are bad

@Venkatesh- you have pointed out towards a great article in our constitution. Based on your interpretation any discriminatory law against men can be justified.

But you are right. The article is being used in that manner only. State is discriminating against men and justifying such laws based on this article. Such approach of the state has given birth to a very different movement- Men's Right Movement. https://en.wikipedia.org/wiki/Men's_rights

Thus dear, for a gender biased taxation law, mere pointing towards an article is not sufficient. There has to be greater justification. Is there any?

Dont hide women strength by saying "women are weeker sections"  My question is, in what way men are inferior to women and incapable. Why the society is looking with myopic eyes. Men always support women in all walksof life. One cannot underestimate men's capabilities. Let us not sustain the argument that women are always weak and men are their chamchas. Let us break this equilibrium and bring a new dimension to the men's role in bringup the family. Let us create a "Ministry for men and child welfare" or amend the existing laws  to include

" Ministry for men, women and child welfare".

We have to be very serious on this issue and make a representation to the central government to enact laws for the same. First I will draft the representation and forward it to you for completion. jai hind

I am in the process of studying various types of gender discriminatory taxes. Identifying discrimination is the first step in eliminating discrimination.

There is no dicrimination, it's a special provision given to women and children.Even today many girls are not educated in this male dominated society and we working women dont even sum upto 30% of the total male working population. Just to boast our interest & bring more women in working force the ministers come up with special privileges. The day when working men & working women are in equal proportion such treatment will automatically cease & no longer exist. So instead of criticizing the system, we should spread awareness & education among the female who are deprived of even the basic amenities like education.

Rajesh Kumar (Advocate)     22 February 2010

Asha, great argument without much substance. Tax benefit to educated working women, earning around 2 lakhs p.a. (11 times per capita income of India) because some other women are poor, uneducated and not part of working force! If this is not gender discrimination, nothing is discrimination at all.

Well, nothing ceases automatically- law is expression of power structure in the society. That structure is required to be changed. Without changing that structure, no law will change. Men, who are discriminated required to express their anger on such blatant gender discrimination and things will change.

I can sense change. A few days back Law Minister said that all laws will be made gender neutral in four years.

In the opening address in the Parliament, the President refrained from making any specific gender biased announcement. I hope Rail Budget and Union Finance Budget will try to remove the gender discriminating policies/laws.
