Form 25, section 39

Dear all,

If one of the inventor is from India and another from USA and are filing the patent application as a natural persons. 

If both of them wanted to file the patent application abroad first without filing in India

Does the Indian inventor has to file Form 25 seeking permission to file abroad?

The information provided by you is not clear.

it has been clearly mentioned in patent act that indian applicant must obtain a permission from controller general before filing any application for patent outside india. So i think he must do so by filing form 25.

I think forum visitors will be able to answer this question more precisely if could provide some more details

It is preferable to file form 25 and take permission.If the applicants do not plan to take out a patent in India then they did not follow the procedure under section 39 and file form 25
