Forcing to work over time for women employees.

My wife working for IBM Manyatha tech park, Bangalore, Karnataka. The organisation/department is forcing to work overtime to reach the target hours of 120%. When my wife ask for a leave (since she is pregnent) the below is the reply received from his manager.

Quote:

But for your information : Entire Month of november/December - no one was allowed to go on vacation. Irrespective of 120% utilization. So its just not you, it was account level drop in Utilisation the reason.
Even 1 day of leave did affect the overall. I hope you understand it from team perspective too.

Please indicate the women labour law's which help us to raise a voice.

In Karnataka

 

>> for National Holidays, Festival Holidays, General Elections, Weekly Holidays, Annual leave with wages, Maternity leave, ESI leave etc............. 

 

You may go thru:

 

The Karnataka Industrial. Establishments (National and Festival Holidays) Act, 1963

 

The Karnataka Shops and Commercials Establishments Act, 1961

>> For Work Hours, Overtime, OT wages etc. to your sector you may go thru:

The Karnataka Shops and Commercials Establishments Act, 1961

 

Chapter: III; Hors of work

Sec7: Work hours/day:9 (including rest after 5 hours) , per week: 48

Including OT;10/day

Max.OT hours : 50 in three continuous months.

 

 

 

>> Maternity Benefit Act:

 

A pregnant woman can also request her employer not to give her any work which is of an arduous nature or which involves long hours of standing, etc. during the period of one month immediately preceding the period of six weeks, before the date of her expected delivery or any period during the said period of six weeks for which the pregnant woman does not avail of leave of absence, under the Act. On such a request being made by her, the employer shall not give her such work during such period. {Section 4}

 

The pregnant woman should submit the information to employer on pregnancy and expected date of delivery preferably along with copy of Doctor’s Rx.

 

During this period usually no employer shall ask to do OT.

 

Therefore the pregnant woman employee may reply that she is pregnant and has already notified the employer on it an she may not be asked to do OT.

 

 

If the pregnant woman employee is feeling indisposed due to pregnancy she may state so and if she has to avail leave she may attach copy of doctor’s medical Rx/certificate advising bed rest.

 

The Inspector appointed under this Act is the authority to be approached.

You may ascertain the appropriate govt. in case of pregnant woman employee is state or central and accordingly can approach Inspector appointed under this Act by state or central govt.

 

>> The IT employees have formed unions in Karnataka, AP, West Bengal etc..........................

 

In Karnataka women employees in IT sector have formed a union.

The state govt. of Karnataka has ended the blanket exemption granted to IT/ITeS companies and now standing orders shall apply. Till standing orders are not certified Model Standing Orders shall apply.

 

 

All these enactments must be available at the website of Dept. of Labor of Karnataka or you can buy the latest version from market.

 

It shall be appropriate to discuss with a competent and experienced labor consultant/service lawyer.
