After filing of petition on grounds of cruelty, the husband lost the petition and case dismissed after four years. Is it possible for husband to file another case in same family court to seek divorce or judicial separation citing new evidence but grounds of cruelty and mental harassment by wife.  Is there a time period that has to pass after dismissal of earlier petition? The case was heard and petition has been dismissed after the arguments, primairly citing that husband has not given enough evidence that there has been cruelty.

no you can not file case with the same cause of action and grounds but if you have faced a new cause of action then you can file it again with new cause of action and seperate grounds.
