Fictitious & Bogus Labels & Boxes

Dear Sirs,

I am a fireworks manufacturer in Sivakasis. Now a days lot of illegal manufacturing of fireworks is taking in residential premises. They often depict pictures of famous actresses in the boxes and labelss and with regard to name of the manufacturers they use boxes bearing non existing or fictitious names such "Shivaji Fireworks" and some times they affix words such "Shree" before the name of any existing fireworks who can not fight against such illegal manufacturers.

More prominently most of the boxes bear only "Made in India".

What is the law available to curb the usage of such fictitious labels. I am not talking about stopping of illegal manufacturing of fireworks.

Thanking you,

Regards,

S.Srinivasan

If the labels bear any or a lot of resemblence to your packaging you can file a criminal complaint of piracy of your trademark and also claim damages. You can also invoke criminality on use of safety standards in manufacture as these are dangerous to public safety and the Govt has  set of standars that are to complied with
