Father in laws ancestral property

My husband was only son along with sister to his father

my husband died on RTA On 30:03:2014

my father in law's father died in 1942. 

My father in law has inherited all properties

my father in law is refusing to share and is trying sell  properties and he refusing to talk or share the property to me and to my only daughter.

kindly advise me regarding our share in the ancestral property

You have a definite share in the property, since your father in law has inherited the property and it not his self acquired property and above all your Father on law's died without leaving any will. You should contract a lawyer and file a partition suit before your local civil court.

Agreed with Mr.Surjit Singh. You and your daughter are ClassI legal heir of your husband and his share shall devolve upon you.

The share to his sister shall be determined after examining various factors and state laws.............and if she is not eligible to have share in ancestral property then share of your deceased husband will enlarge.....

 

Approach a local lawyer dealing in civil/revenue/property matters and well versed with local/state laws and obtain injunction from court so that no property is sold and court partitions the property........
