Family problem

my mother in law has 2 kids.one boy and a girl.both are married.my husbands brother in law forced mother in law  to give her property in his name.he told at that time he will look after her.but for past few months he is making so many issues.he had made his own house nearby and shifted there with his family.now he has told mother in law to get out of the house and he forcley did it infront of public..that house is actually mother in laws father's property.now we want to move legally against him..moreover he is leaving the country in few days.can i get a solution that if we move legally ,shall we get the property back

Your query is not clear , The property where your mil residing is on whats name , why you want to sue case

Your query is not clear , on which name the property is where your mil is residing , on your mil name or her fil name , why you want to make a case on your bil , tell your mil don't live with them in their house .

1 - in whose name is the property?

was your Mother inlaw forced to sign a release deed or gift deed?

well, the person who is displaced out of his/her own property though cooercion etc can take action civil and criminal as well.

please reply with precise question.

the property was on mil's name.now the property is on bil's name.

she was forced to do that

now he made her out of the house and the house is vacant,since he is staying in another house.

now mil doesn't have a house to stay

that is why we need to file a case

your mil shall file a suit in the court of LAW immedidately and take possession of the home. Also, she has to prove that she was cooerced in to signing the sale deed/gift deed/release deed.

Further she will have to approach the court. simple here you will not get the results. move fast! which city are you located in ?

what is the procedure?

is she has to file a complaint in nearby police station,or directly in court.

how the property tranfer in your bil name , now if the property is in your brother in laws name and same is in his possession then he has all right to save his property, your mil has loose her right over it , you can file a civil suit in the civil court but it will difficult to prove that the property is transfer under coercion , gather the evidence , request your neighbour to give evidence in your favour and then move immediately to the court.
