Fake insurance policy

Friends,

 

claim petition is filed U/s 166 of MV Act against owner and insurer of the offending vehicle. The contention of the insurance company is that the policy copy produced by the claimants is not issued by them and hence they are not liable to pay compensation. The claimants are third party. The owner of the vehicle is appearing in court and is stating that the policy is issued by the said insurance company only.

 

Under above circumstances, I need Judgments stating that insurance company cannot avoid its liability to third party and are liable to pay compensation to the claimants.

 

Kindly do the needful.
