Execution of child visitation order from lok adalat

498A filed in Mar 2015.  CRPC 125 filed in July 15.  The two cases are under trail.

I got visitation order from Loka Adalat where my wife agreed to show my 2 years old daughter on every Saturday and Sunday.

My wife showed my daughter for a min at a school beside their house and said me to go as she showed baby.  My daughter is very scared up of me now and not coming near to me at all.  She must have tutored by her mother about me badly bacause my daughter used to play with me earlier very well...When I questioned my wife about it she says I must have done something to my daughter during my wife abscence which is the reason my daughter was scared.

My Wife and her mom also talking non-sense when I went to visit my baby...

Now my question is how can I execute my visitation order in a way that I can avoid this non-sense and by protecting myself from them as I forsee some threat to me interms some more flase cases.

  • If there is a dispute between the parents over custody or visitation rights, they will be offered specialist counsel through the offices of the district magistrate. The goal of the counselling is to assist the parents with finding a solution to their dispute, taking into consideration the best interests of the child.

File a fresh application before the court praying for visitation rights and pray before the Court that u should be allowed to meet your daughter on any day as convenient to you in a children's room if there is in court, dont forget to mention that the despite orders of the Lokadalat your wife is not allowing you to meet your daughter.

All this is normal, she giving tuition to kid against you etc.  if you both were proper, would this day have come? Its never ending battle in court where nobody wins, everybody loses.  Court  might order counselling etc, which is of no use for people like you, you guys did not listen to your own selves, what will you listen to some salaried persons advice?  All that is of no use.

 

She has disobeyed the order of the court, you can file permanent custody application in FC.

You file application u.s. 26 of HMA 1955 stating the facts seeking permanent custody.  Also talk to wife personally and formulate shared parenting plan and take her signature on the same and submit to court.

Thank you all for your advice.  Please suggest me a way other than approaching a regular court something like Lok Adalat which will be effective
