Esi eligibility

if employee is on payroll but he crossed retiredment age 60y and company give him extenson of 1 year job period. company is not deducting his PF. whether ESI is applicable for that employee who is over 60y?

i am HR officer and i am confused whether ESI is applicable for that person or not who is retired and pf is not deducted

There is no age bar for ESI.

EPF; The entire 12% of Employer's+Employee's contribution may be credited to EPF. ( NO contribution to EPS).

ESI is applicable till he is in employment. There is no age bar in the ESI Act.

As a HR person keep your self updated and preferably advise the employer nbot to commit any violation.

If you are designated signatory don't take any violation on your shoulders.

ESI is applicable to employee whether he is regular or contractual.
