Dispute property

dear sir, mere dada ke dwara kharidi gyi property present time disputed hai. dada ki death 1996 me ho chuki hai.

mere dada 75 saal pahle kiraye ke makaan me rahte the. wo makaan mr. nigam ji ka tha jinki 4 deti thi. nigam ji ne wo makaan do hisse me kr ke charo detiyo ko gift kr diya. mere dada ne wo makaan nigam ki charo betiyo se kharid liya jisme se 2 betiyo ne to registry kr di.aur baki 2 betiya registry krne se pahle mar gyi.tb se wo pura makaan mere kabje me hai. aj 70 saal baad koi urmila nigam saamne aati hai kahti hai ye sampatti meri hai .mere paas 1974 ka gift deed hai. jo meri mausi ne mujhe kiya hai. aur mausi nigam ji ki charo betiyo me se ek beti hai.aur show ki gyi gift deed us hisse ki hai jiski registry nhi ho payi thi us wqt.aur hissa urmila kisi ko sale kr rhi hai . kya ye bik payega urmila ke dwara. jinka 70 saal se koi ata pta nhi tha.

to dear please ye btaye 60 se 70 saal se koi nhi aaya .

kya court inse ye nhi puchhega ki app 70 saal se kaha tha. aur isi property ka case court me pending hai.2 anya logo se aur stay me mere fevour me hai 2011 se.

It is believed deceased owner was Hindu.

1. If the owner gifted the property by valid gift deed (registered) then ownership/title is transferred with immediate effect.

IN that case the donee can sell further.

2. If the owner gifted the property by invalid gift deed (unregistered) then the ClassI legal heirs (mother, spouse, sons,daughters) shall inherit equal share by inheritance.

The ClassI legal hiers can sell further.

If your father paid consideration (to buy) and has evidence then he can produce it and ask the seller/legal heirs to come forward and register sale deed.

Approach a very able counsel specializing in revenue matters ASAP.
