Discontinue from job as teacher after giving 3 years

I worked in D.A.V. international School in Ahmedabad from June 2013 to May 2016. i had faced interviewe and got the appointment letter as adhoc teacher on contractual basis.after one year they took panel interview and promise me to put on scale of Prabation and not provided any letter after a new teacher incharge came and she also not issued any appointment letter and she replied the previous committee was discarded and again you have to face panel interview and its just formality for in-house teacher and it wont affect your job . But after a week time when actual vacation time came principal announce there is no selection in panel interview and its your last day on 07 may 2016 and also not gave any written notice, just verbally spoke to me as well around 40 teachers those who are near to get scale and hike in salary. I inform to management and asked for the reason via mail but not get response till date. can i go labour court for the same. pl. advice me fresh

did you get identity card, salary slips, tds certificates? you must be having bank statement. take all documents with you and approach an able counsel specialising in labour laws. you have a decent case.

Teachers are not covered by the def. of workman as in ID Act.

So labor court may not be the appropriate forum.

The school is affilliated with which Board?

Did you sign any contract? If yes, post the relevant extarcts from it.

Is there any united teachers forum and are you a member?

The paper as appointment and contract given on joining and after they had not issued any letter ... i have ID Card, Salary Slips and PF Statement of last two year ...and i also wrote mail regarding to issue nature of appointment and Scale aslo not raise after facing panel interview after two year of experience ...

School affiliated with the CBSE Board

 i not joined any united teachers forum .. if any suggest me

i signed the  contact

i also completed my 240 days in School and stil they are refusing to take us in school and shown result like you get fail in panel interview which already faced before one year also.

    You may go thru Serrvice Conditions/rules, Contract of Service in CBSE Affilliation Bye Laws of each year starting from the year you joined.

     

    e.g:

    10. Staff and Service Conditions;

    5. Normally a teacher should be engaged as a whole time employee except in special cases where work load does not justify a whole time teacher. No teacher, teaching the 17 Secondary, Senior Secondary classes shall be required to teach more than 3/4 of the total periods in a week.

    I want to take advice

    1. shall i continue and can i get my right from the school 

    2. Or which are the steps can we take against the school with use of CBSE Affiliation Law??

    All affected Teachers may join hands/form association  and consult an able counsel specializing in service matters.
