1) Would like to know whether a discharge application can be filed once Charges are framed in the Court.
Still no trial has been started.
2) Also from a group of 40 accused only 15 are present for discharge application, rest whereabouts are not known. Can discharge application stille be filed?

Once charges are framed you cannot file discharge petition,you have to initiate quash proceedings.

It will be too late to flea discharge petition once a charge sheet is filed, it is better to go for quash before the high court.
