Demand notice under section 138 n.i. act

A cheque is been issued by a Proprietorship Firm Current Account and It got dishonored. The Payee sent the demand notice to the Proprietor name instead of Proprietorship Firm. Is the Legal Demand Notice is maintainable in the court of law? what would be the consequences on this point?
