Delay in judgement

Dear Sir,

I filed a case in Central Administrative Tribunal , Jabalpur in the year 2012 when I was posted at Bhopal. Our lawyer says that the bench is not being constituted and hence delay in getting judgement

of the case. Now I am posted at Ranchi. Can you please suggest me the course of action for getting

judgment at an early date.

Getting judgements at early is not in our lawyers hand. The concern judges have to decide.

getting Judgement in India court is really a big deal my dear friend.

Our courts takes years to solve the cases and keep collecting cases and atlast the same reason is being given that for every one million cases only 1 Judge as per me a single Judge in his life span cannot solve 1Million Judgement so they keep delaying so that both party settle out of the court and people waiting for court getting Judgements with a history record breaking stories.

When we talk about professionalisum this is a place where government has to take tough decision to make our law and orders in place.

New steps are being taken to fast track law and order but our system is habitute that our frinds still drag the case like its same old system of court even in fsat tracks.

90% case before starting has the same reason for delay.

1. Opposite party does not appear - next date

2. Advocate from one side seek 1 or 2 months to study the case - next date

3. Advocate health issue - next date

4. Opposite party Health Issue - Next date

5. Judge steno absent - Next date

6. Judge absent - Next date

7. Now case start after 1.5 years and both party present the case - Next date

8. advocate exchange the document and files affidavit for documents submited - Next date

9. Opposite party missing - Next date

10. Opposite advocate out of station - Next date

11. Opposite advocate out of country - Next date

12. Opposte advocate home function . Judge serious warning - Next date

13. Advocate present some document and our advocate present his documents - next date

14. Judge verify all documents - Next date

15. Cross examination - Next date

16 - Opposite party missing health issue - Next date

17 - Advocate has some work next date

18 Judge warning - Next date

19. Cross examination of first party - Next date

20 . second party missing for cross - Next date and last warning

21. Advocate not prepared cross questions - Next date

22. second party Cross examination - Next date.

23. Document validation - yes/No and filing the document - Next date

24. At last documents are numberedand validated - Next date

25. Now the case ends here no no no

This was my personal story and for each date you get there is minimum of 15 days gap and 1 month gap in May.

if you have valid reason with evidence try to discuss with your higher officials and settle the issue
