My mother was 1st owner on a flat with my father as 2nd owner. She has since passed away and we need to get her name deleted and share transferred. Under the Hindu Succession Act, since she passed away without a will, the Society is saying that her share will be distributed between my father and me (I'm the only child). What is the process to get this executed? Will a simple letter to the Society suffice? The Society is asking for a Declaration Deed that has been registered. Please advise if this is necessary and if not, what are the correct steps?
