Curative petition ???

Affidavit is filed with the curative petition or not ??

Accused is in jail ...

Can we filed application of bail along with the curative petition ??

Curative Petition is re-examination of its verdict where the petitioner has to aver specifically that the grounds mentioned therein had been taken in the review petition filed earlier and that it was dismissed by circulation, a concept evolved by supreme Court in Rupa Ashok Hurra vs Ashok Hurra in (2002)4SCC 338. It is certified by a senior Advocate. The curative petition is circulated to three senior most Supreme Court judges including the judges who delivered the impugned judgment. I don’t think curative petition would lie in bail matters as there is no review in bail matters.
