Crossexamination of witness

In warrant case u/s 406 before magistrate,cross examination of witness was reserved by accused. Now magistrate has started arguments of both parties for deciding whether to frame charge or discharge the accused. But reserved cross examaination has yet not been taken place. In the light of the above,kindly let me know as to whether magistrate can pass the order to frame a charge or discharge the accused keeping reserved cross examination pending. Amar
