Magistrate Court dismissed petition filed U/s 91 of CrPC and in this petition mentioned that the listed documents assist the court to arrive to the truth and to arrive at innocence of accused..... in petition it was exaplained how the documents would disprove the alleged allegations whereas the court dismissed the petition.
Also in the CrPC-91 petition mentioned that the documents are rwquired to mark as exhibits in support of accused during the defence evidence stage.
While the court dismissing the petition said that on next hearing date accused shall bring defence evidence else defence side evience will be closed ..... then I made submission that without calling the documents U/s 91 of CrPC the accused is not in position to mark those documents as Exhibits while giving defence evidence ..... but court neglected without saying anything.
