Company not releasing original documents & f&f

Hi,

I joined a company Berkowits Hair & Skin Clinic which is a private company in South Delhi-India, 110046, I started to work under probation period for 6 month but after joining I found that things which committed by HR initially were just different & realise, that was not right organisation for me therefore I resigned from there next month but now they are not releasing my original High School & Intermediate certificate & 18 days salary as well. Please suggest what should I do & what is the procedure to fire the complaint against them.

Employer can not have any lien on your original certificates, it is your property. You can lodge criminal complaint too. As per Delhi Shops and Commercial Establishment Act notice period/pay for 30 days service is Nil. The Inspector under this and Payment of Wages Act can be approached. Better to proceed further under expert advise of your lawyer..
