Company not paying gratuity

One Of My Friend Has Worked 4 Years And 8 Months In His Last Organization. When He Asked The Company About The Gratuity Payment, The Company Denied The Payment Saying That You Have Not Worked For 5 Years. As Far As I Know If An Employee Completes Continuous Service Of 4 Years And 8 Months, He/She Is Eligible For Gratuity. I Want To Know What Is To Be Done In This Case ?

Submit FormI under proper acknowledgment.

Let the company decline in writing.Has the company declined to pay in writing and quoted any reason, substantiated with any Act;Section/subsection/judgment by court of law,  in writing?

 

The employee may mention in writing under proepr acknowledgment that he/she has not been supplied with 'Notice of Determination of Gratuity' and payment of gratuity...................................although he had represented in office on dated...........................to Mr/Ms..........................designation....................name of company................... address........................
