Community road not handed over

Dear sir, our apartment is surrounded by independent villas and we have a common access road. We understand from builder that the road was formed for the independent villas but the same has to be handed over to gov so it will be a public road. Also our apartment approval shows it as a only access road for us. Now the problem is they are denying acess to our specific vehicles and making so many conditions to use the road. Also they are saying that the road will not be handed over to gov. They have also constructed a arch on the road and stopping all the vehicles... Pls advise whether they can do this... How to confirm that this road is handed over to gov. How they can stop people from accessing this road...

Let a local advocate study the agreements and relative documents and request him to file for injunction for handing over the Road to Govt for unrestricted usage for all. You may use RTI to get copy of approval terms and conditions when permission to construction of your apartments/villas and definitely the conditions will support your contention in writing as approval term and condition by Municipality. If there is a such condition, you can move the Municipality through complaint, and they have the powers to take over the road. Move as a group collectively for undertaking such matters against a powerful builder and influential persons in the villa.

Thank you for your response sir. Also would like to know if the road is gov road, do they have any rights to construct an arch over the road and put boom barriers on the road... As our flat residents are facing many issues as they have a security over there and stopping all our vehicles...

Everu semi or permanent construction / erection is subject to such specific permission from the authorities that have the rights over the road. If the constructions are no permitted , a complaint can be filed direct to commissioner asking him to stop the encroachment immediately and you can also raise your objections. Move always collectively as a group in such matters, and never take up those issues in individual name, and consider your and family safety as priority in fighting over with influential and powerful forces that considers everything including violations as granted in their favour with such arrogance that they can manage any thing and every thing.
