Common area in society premise

Hi,

 

Most of the flats in our society are sold by the builder and in the sanctioned plan of the society basement is made for car parking and now we come to know that builder is not willing to do so and interested to sold that area .

And when we ask for the same he is telling us parking cannot be possible in that area due to some construction errors.

 

My question is

 

1)      Whether builder can sale such area.

2)      Or any common area in the society .

3)      Also he is intentionally delaying the society formation process . (Society not formed )

4)      Some work in the society building is still pending .

 

What we can do as members of the society.

The builder can not sell the common area.  You can approach the local sub registrar of cooperative societies for formation of society and its registration. If the builder has failed to complete the construction, the concerned may approach the consumer forum

Could you kindly let us the DOs and Don`ts in the common area and what are all the different types of violations and what will be the penalty charges.
