Clarification

In a civil suit about dispute of ownership, the Magistrate of a taluk gave judgement on 31/8/2018 Any time period is there for appeal to higher court In this case I am plaintiff and judgement is in my favour ,How long the respondent is given,after degreed How to get the copy of judgement and documents submitted to court in the absence of advocate can I apply indivitually and get it

Appeal to High Court - 90 days from the date of decree Or order.

Appeal to any other court - 30 days from the date of Decree or order.

You have to apply through your lawyer to get a certified copy of the court order.in case if you're Lawyer not furnished the copy to you, or refusing to give the same to you, you can very well file an affidavit in person or through some other advocate. To get a copy of your judgment one needs to pay stamp charges.

Even after that they can file appeal thru condonation of delay u/s5of limitation act.so u file caveat petition in appeal court.
