Claim case

Hello all learned, MR.x who is rikshaw driver while going to send pupils at school meanwhile for the taking milk he parked at the proper side of his rikshaw, meanwhile from the front side of road a truck came with full speed and dashed with the rikshaw. In the said an accident two children got death. Now for claim case truck driver, insurance company of truck driver and an owner of the truck has been joined as a party and claim case has been registered. Police has not recovered any papers from the rikshaw driver in the case of claim this rikshaw driver is not joined. Claim case was lodged by father of child who was seated in the rikshaw. Whether is it mandatory to joined this rikshaw driver, and an owner of rikshaw and insurance company of the rikshaw. Pls mention judgment. regards
