Civil dispute: construction on unpartitioned land

My cousin brother is constructing a new home on our unpartitioned land without the consent of all legal heir.
He has already dwelled the pillars and walls.


I need to stop this work and pray for further construction within the respective land and lawful limits.

 

Kindly advise me in this regard and provide me respective references to proceed the case:-

1) Constitutional obligation.

2) Centre and state act and laws (Bihar in this case)

3) Supreme Court Order

4) High court order

5) IPC and CRPC procedure, etc

Yes, I am going to represent myself. Although, I am an Engineer by profession.

You file suit for partition and take stay for illegal construction till suit is disposed in competent civil court.
