municipal corporation had sent MRTP notice to the plaintiff to remove his illegal construction.
plaintiff has filed a case against corporation to the city civil court. the other party who is a sufferer
of plaintiff's illegal construction has applied for chamber of summons 6 months before to the city civil court to
join corporation as a party. Here, plaintiff's lawyer orally told judge that he has no issues if other party joins and
he is not interested to file an affidavit to reply the same. after that judge keeps giving new dates for the hearing,
it's been six months now, plaintiff's lawyer does not come for the hearing.
IN this case the sufferer party has to pay lawyer's heavy fees for every hearing. but till date
there is no outcome of the case. what is to be done now ?
- Is it possible that sufferer party withdraws his name from chamber of summons ? Let the corporation
and plaintiff go ahead with the case ?
- Can he file a new case at High court for illegal construciton causing immense problems to him against the opposite party ?
