Cheque dishonoured

Hello Sir, My husband has paid to one of his friends Rs. 5 lakh for business purpose on loan. Now this person is not ready to return the money. He had given a cheque of partial amount of Rs. 1.25 L which was dishonoured.

In this case, what can be done by us from legal perspective?

You can drag that person to court for cheque bouncing offence.

Yes,initiate  proceedings u/sec 138 of N.i.Act against your husband's friend.

You can initiate 2 proceedings against that person simultaneously -

1. Sec 138  Negotiable Instrument Act Proceedings for Rs. 1.25 L

2. Civil Recovery Suit for Rs. 5 Lakhs
