Cheque bounced how can i get money

Respected  Sir/Madam,

One of the persone want to give money so he gave me cheque on 10-12-2015 many times asked him  to depposit the money in his account but still didnt depossited so i deppsited cheque in Bank on 13-02-2016  than cheque bounced, So now what should i do forther  please guide me , can i get money with him now ?

Hi Veera,

You should initiate action immediately under the Negotiable Instruments Act. First you will have to send a notice under s 138 of NI Act to the person who issued cheque within 15 days from when you received information about cheque bouncing from the bank. So please act on time. Then if the amount is not paid within 15 days, you have to initiate a complaint to the Magistrate Court. Kindly indicate the place where u deposited the cheque is important for jurisdiction.

Secondly you should file a summary suit side by side as it will put pressure. 

If u are located out of Delhi NCR or Mumbai, I can do the required work.
