Certificate of completion

Hi, My builder has registered my apartment in my name, handed over all documents to me and told me congratulations flat is handed over to you in 2012. Builder did not give me Certificate of completion or OC. Now for past 5 years he's charging me maintenance fee every month and am paying it. Can i stop paying maintenance and demand CC/OC ? Is it legal foe me to stop paying maintenance at this point? Please advise.

Occupancy Certificate is necessary while seeking loans from banks and financial institutions or while applying for water, sanitation and electricity connection. Legally, a homebuyer cannot move into the property without the document. The certificate is also important in scenarios when a buyer applies for Khata or when purchasing a re-sale flat. The sale of the apartment would not fetch a good price without OC.Do not pay maintenance unless they issue OC.
