a CAT case of central government employee (pay scale 4000 to 6000) claiming parity in pay scale of another department of central government (pay scale 5000 to 8000 ) for post of DEO (both department having identical eligibility conditions, qualifications and nature of duties).  The case was filed under 'equal pay for equal wages' principle.  CAT dismissed OA with two observations:

The equal pay for equal work has to be seen within the context of the particular employer or particular department.

The tribunal can not interfere in matter of creation of posts and the determination of pay scale and eligibility criterion thereon.
