Cancellation of booking of apartment

Hi I have booked a apartment in August 2014 by paying amount of Rs 2 Lakhs only. For agreement signing i paid another 13 lakh but agreement was never signed due to financial contraints from my side. Both amount were paid by cheque. Now I am cancelling the booking and i am asking for refund from the builder which i am not able to get. Kindly advice what are my options and how can i recover my money. thanks Gagan

Send him a notice mentioning that you are cancelling the agreement for so and so reason and ask him to refund the advance in accordance with the cancellation clause mentioned in the agreement failing which you will take the issue to the district consumer forum for further action
