Can wife transfer case from Ahmedabad to surat

Hi Expert, In case where the marriage was solmnised at Ahmedabad and husband and wife last cohabitation was at Ahmedabad . Wife is residing at Surat. Now husband has filed divorce petition. Wife wants to file transfer of divorce case from Ahmedabad to Surat before Gujarat high Court u/s 24 of CPC. Can wife file this application? Thanks Nirav

Yes she can file transfer of divorce case from Ahmedabad to Surat before Gujarat high Court . but it depends upon judge he give decision of transfer or not.

She can file tranfer case to her residence place jurisdiction courts. According to CPC Where a person has a permanent dwelling at one place and also a temporary residence at another place, he shall be deemed to reside at both places in respect of any cause of action arising at the place where he has such temporary residence.
