Builder not providing refund

I have booked a flat during pre launch in 2014 April and after 6 months they sent me sale and construction agreement and I decided to cancel without signing due to their strict clauses. During booking they took from me principal amount, vat and service tax. Now they are saying vat and service tax cant be refunded. Since there is no sale happened and no agreement signed why can't service tax and vat be refunded. ? What does property law say about this. ?
