Builder cheating us

We bought an shop in an under construction mall in New Delhi in May 2008. We paid the full sale consideration upfront with the agreement that till the time construction is completed, the builder will pay us Rs. 25,000 per month as assured returns on our investment. The agreement is in the form of MOU on Rs. 100 stamp paper. This builder paid us for 2 years till May 2010 but has stopped paying us since then. Also, construction has stopped on the site and there is no clarity. The promoter of the company does not pick up phones.

How can i enforce my right ? I do not want my money back but i want the assured returns till completion of the property and then the property itself.
