They can claim heaven. But who has it in the back pocket to give it when they ask it? Better to comproimse with the person who hit from behind.

First file online complaint with necessary certificates, and if possible get some CCTV coverages if possible under RTI or collect it from near establishments that is having that facility through police.
Depending on the police report contact advocate for receiving compensation only if the driver is having a valid driving license, helmet, and vehicle insurance. The car owner is not bothered about insurance claims as he might have taken insurance and he wants relief from a criminal complaint and the compensation part is the responsibility of the vehicle owner.
