Bda notice after 36 years of aquisition

Dear All,

I have purchased a FLAT in Bangalore in 2004.

It was a JDA between Builder and Land Owner which has total 15 flats.

8 flats of Builder share and 7 flats of Owner share.

 

Bulder has paid all the taxes and Khata was on the name of land owner at the time of construstion.

Bulding plan was approved by BBMP.

I have bought from Builder's share in 2004.

We are in the possession of the flat since then.

KHATA is also transferred to our name.

We are paying individual taxes per flat since 2004.

But last week we got a notice from BDA saying that surver no is acquired by BDA in 1977 and compensation is awarded. It mentioned land owners father's name in that. But as such compensation is not paid to him directly(reason not known) and it's paid to CIVIL court.

BDA mentioned that this survery no is acquired for forming layout, which didn't took place.

Now the Builder says he is not aware of such aquisition by BDA and Land owner never said about these. When contacted LAND OWNER he also tells the same that he is not aware of all these earlier.

Now in this context:

1. Does BDA right giving notice after 36 years?

2. How come BBMP approved the building plan?

3. How they gave the KHATA on our name?

Please let us know our stance on this notice and what should be done.
