Sir, I am working as Superintendent, I Addl. Judicial I Class Magistrate, Kadapa. Police filed a Charge Sheet against Private Doctor of Private Nursing home and its staff (A.1 and A.2) u/s. 338, 201 r/w. 34 IPC., for the Offence of removal of Little finger of a baby, referred the baby to speciality hospital for better treatment, supressing his act of removal of little finger to the parents of the baby.
I request you to clarify 338 IPC., will apply for the act of unnecessarily removal of little finger of a baby, and let me know the correct section of law under which the doctor is liable for punishment for his negligent act
