sir my 498a started in march 2011 charge sheet submitted in october 2011 and charge frame in january 2013. Total 9 witness including 2 IO and 1 RO. From the date of charge frame more than 18 date was fixed for evidence but in 12 date(12 times) APP filed time petition praying for date.
NOW IN MY NEXT DATE CAN I FILED A PETITION IN THE TRIAL COURT PRAYING FOR SPEEDY DISPOSAL OF MY CASE QUATING HIGH COURT JUDGEMENT WHERE HIGH COURT DIRECTS TRIAL COURT TO STRICTLY ADHERE TO CrPC 309 AND NOT TO GIVE UNNECESSARY ADJOURNMENT AND CONCLUDE THE CASE AS EXPEDITIOUSLY AS POSSIBLE WITHIN 10/8/6 MONTHS AS PER THE CASE.
IF YES, THEN IN WHICH SECTION I SHOULD FILE THE APPLICATION? PLZ GUIDE ME
My lawyer is saying we cannot file such an application. he is not objecting the time petition of APP.
