Application for restoration

APPLICATION U/S 13B IS DISMISSED ON DEFAULT (FOR NON APPEARANCE OF EITHER PARTY) HUSBAND GAVE AN APPLICATION FOR RESTORATION. BUT WHO WILL BE THE RESPODENT IF THERE WAS NO RESPODENT IN ORGINAL MUTUAL CONSENT APPLICATION.??

Section 13B HMA Petition has to be filed jointly by both parties as both are petitioners in it and even for restoration both parties have to move joint application, but that may not be allowed by the Family Court and fresh joint petition under section 13B HMA by both parties will have to be filed.

I believe even a joint restoration application shall be maintainable before the competent court.
