Hi...father passed away and left a Apartment without any will. Can the property title be transferred to Mother? If apartment needs to be sold, who can decide. 4 children 2 Males and 2 females. Male being the eldest. To sale the apartment, who can take the sale proceeds & who?

Father died intestate, property devolves upon all legal heirs. If heirs wants to transfer the property in mothers name, they have do it through relinquishment deed, to be signed by all legal heirs except mother. If the legal heirs wants to sell the property all of them have to sign in sale deed and the proceeds should be shared equally as per law.
