Advice required on agreement where seller not registering

Dear Sirs,

  We taken a plot on installment basis from 1996 to 2001 year  and paid the Final installment.But from 2001

onwards the Realestate company is postponing to register that plot against.From last 1 year they are saying we

cannot Register and saying  us (advicing) go to court or police station what ever you want.

               some one told us  For any agreement which is on 100rs stamp validity is present upto 3 yrs.Is it true?

what are the alternatives how can we have to take action against that Managing director o real estate company.

Now the real estate company is closed.

Kindly require your suggestions how to proceed to get justice

Dear Madam,

Your case is a perfect case of  "Deficiency In Service" by the Builder./ Real state company and it's Directors. You can file a consumer Court complaint against that Company through all the directors for this and claim heavy damages on that pert of deficiency in services by him. plus claim for the suffering and damages to you.

You have not mentioned that whether the possession of that plot has been handed over to you by the real State owner or not? Take all proofs of the payment and on the basis of the Agreement whether it is on Rs 10 or Rs 100 stamp paper submit case in the consumer court as it is much speedy now a days in discharging the cases.

On the other hand you can also file cases for Specific performance and recovery of the money with interest and damages in Civil court.

1. First lodge a police complaint of cheating you by refusing to register the sale deed even after collecting the entire consideration,

 

2. After that file a complaint case before the local District Consumer Dispute Redressal Forum  alleging deficiency in service and unfair trade practice claiming immediate registration of the flat, damage and cost.

I disagree with above experts partially.  Non registration of plots will not attract Consumer case unlike Flats.  This is purely a civil case.  However, I agree that a police complaint can be filed for fraud and cheating for non registration of plot and also absconding and closing the office with evil intention.

1. I am sorry. It escaped my attention that there has not been any mention of  structure/house standing on the plot which is required to file the complaint case before the Consumer Forum,

You may lodge a complaint with the local police for fraud and cheating offences, which may bring the real estate owners to the negotiation platform upon which you can achieve the object.
