Why the contract of fire insurance and marine insurance is always contract of indemnity???
Sometime its can be mature by accident or an act of god as the case may be.
In this situation there is no fulfilment of requirement,(i.e the loss must be caused by promisor himself or any other person),of section 124 of said Act.
The claims are always paid on actual loss suffered irrespective of the cause, after investigating into facts as t whether it was fraud or false claim.
