quantum of punishment in 498 A

Sir wife has filed 498 A on me. I know that her allegations are false. Lots of people asked me that in 498A cases, men can not escape even if he is innocent as judge generally order in f/o women and men has to go behind the bar. I am govt servant and afraid of this. Kindly tell me the facts.

conviction rate are poor in 498A IPC case after trial.The law are equal for both the genders.File a Quashing Petition u/sec. 482 Cr.P.C.in High Court,failing which face the trial by producing proper evidence.

Total misuse of the provision has already been expressed by the Supreme Court, even then lot of harashment but few convictions of the husband.

Though 498A case easily be initiated but charges are hardly proved.

I think your apprehension about is totally misdirected more so if you have already got bail in this case.

you are worried about quantum of sentence.

However, as a govt servant the quantum of sentence is irrelevant as far as retention of job is concerned.

You have to keep good relations in deptt as even on acquittal on technical grounds the deptt has the liberty to initiate disciplinary action if they so desire.

If 100 persons are accused and 98 are acquitted.


How does it matter if you happen to be in in remaining 2. So defend case sincerely and not think elevated by statistics.
