pet dog bite a 12 year boy

Last night on 24 April 2015 when I came from office. I rang the Bell to open the door,my mother opened the door suddenly our pet Dog come out and caught that boy running in street. I took that boy to the hospital and he get proper treatment their then I dropped him to his home. Where his mother make a call on 100 against me. PCR come and ask to setal the matter. They want to punish the pet. Then I give confidence to them we will drop that pet into mcd or other NGO. But today in morning I received a call from local police station and the ask to come to the police station . Now what to do?

well police will record your statement and press charges against you under Section 289 of IPC,which deals with negligent conduct with respect to animal

Ajay Sir according to the section 289 of IPC their is provision to fine Rs 1000/- or 6 month jail or both.

I do my duty like a good citizen by done his proper treatment.

I would like to ask what would be decison in my case fine or jail?

Mr. Vikram,

Shri Ajay Sethi has provided you the legal position of the case. But, it seems you are already aware of the provision and your reaction indicates, as if you have the desire to discuss the issue with some academic interest, not the real problem with you.

However, if you really have the problem, the plea you have presented is required to be given before the police or the court, not here, who have to investigate/ decide on the complaint. Nobody amongst us can anticipate what would be your fate (fine or jail) in the court case. That depends solely on how you are able to defend your case in the court of law.

Ajay sir write about section 289 of IPC here.Then i searched on net what is actually 289 IPC ,from their i came to know about provision.

Now pls guide what to do?

You should have been satisfied with the position explained by Shri Ajay Sethi. If you had any doubt about that or wanted to forecast the events to come, you could well have discussed with your lawyer, if an when the case would have been filed in the court of law against you. You should be aware that strogers are not replying your query here.

However, as a student (as your profile speaks about you), you should not expect that we would help you solve your academic exercise. For that you will have to tease your own brain, if you really want to be a good lawyer.

you said that you did duty by taking child to hospital.

well that does not wipe out the crime.

Given facts indicate that criminal liability of you and your mother started when the unleashed dog bolted out and attacked the child.

It is a harsh reality that dog lovers do not like to leash their dogs and in core of heart they at times give second priority to safety of neighbors.

Unwittingly, you have given the answer to his academic query, which he seemed to have desired as a solution.
