oral agrement

dear sir, person A sold the land to B in 1988. B paid amount and took possesson.there is no agreement or any document except A gave original document to B while left the land. B devleped the land and built kacha house in that by paying house, water tap taxes to panchayat on B name. Now B wanted to sell the land. We paid ten thousand(total 1lakh 30k) as advance and took possesion balance to paid in 4 months and register. We and B asks A to register the land to us and he agrees. After 4 months we ready to pay balance amount. A and B refused to rigister and asks us take back our advance and vacate the land. What should we do. We have any legal right to rigister the land by paying balance amount or vacate the land.

The previous papers are not with you.
The suit if filed in court would not stand.

I advise you to take the money and search for other land and do not buy such land where title deeds are missing.

dear sir, if person B ready to make agrement with us by taking balance amount and give us original document of title of A. is valid?. Or if A Rigistered the same land to another person by duplicate document is valid. Advice me sir.

I think you are taking this issue very lightly. It is not clear whether you entered into any written agreement while agreeing to buy the property. What are the contents of such written agreement if any. Without knowing all the details, please take it, nobody will be in a position to give you an appropriate answer, which will be of use to you.

Any view that you get from anybody, without examining the documents will not be of any use to you.

thank you sir, this issue is friend of mine. As he is homeless poor he commit to purchase this kacha house. Now A and B opposing each other. Now B ready to make agreement with us if we paid balance amount and we never asks him for rigistration. He wil transfer us what right he has oves the land and gave us documents he has. A paper owner of land ready to rigister ( by obtaining duplicate from S.R.O.)us if we ready to pay the same amount to him as we are in possesion in the land. Who have right to sell the land? A paper owner with out oiriginal document and who left village 25 year back or B possesor of land with original doc. Of A and tax payer of house. If we pay to B and get agrement A will go to court.If we have right ready to face on courts. Advice me sir.

contact a local lawyer as advised by experts title to property is not clear and marketable . dont buy the property

You are advised not to venture into such purchases because it will ultimately land up in court cases, thereby you will lose your peace, money, energy and health etc, decide.
