mutual consent divorce

(Querist) 29 August 2014 This query is : Resolved 
Please clarify whether in mutual consent divorce, If one petitioner is living in USA and mutual divorce filed in Delhi, Can Power of Attorney given by petitioner to his father, can appear and divorce can be granted,if petitioner do not appear on first and second motion.
Pls provide judgements,if any.

we dont provide citations . court may insist on petitioner personal presence or court can verify petitioner consent through video conferencing

Yes, as per decision of Mumbai High Court, video conferencing can be arranged to facilitate MCD.
