Can a person marry while the mutual consent divorce application in pending before the family court is pending

No. Till the previous marriage dissolved by decree of divorce, the parties are still married and not free for remarriage.
The second marriage during pendency of divorce petition will be null and void and amount to offence of bigamy.

What is the opinion and advise of the lawyer(s) engaged by the parties (both) to MCD ?
Why did you not put the question to him/her whom the parties have paid legal fees?
Why did you post this academic question before the experts and rely upon FREE SOCIAL SERVICE, meant for needy litigants, that too, on the basis of limited information and without disclosing your identity?
